CALIFORNIA CONSUMER PRIVACY RIGHTS STATEMENT

This California Consumer Privacy Rights Statement (“CCPR Statement”) applies solely to the personal information we collect from visitors, users, and others who reside in the State of California. This CCPR Statement is designed to address the relevant legal notice requirements of the California Consumer Privacy Act of 2018 (the “CCPA”) and uses certain terms that have the meaning given to them in the CCPA. This CCPR Statement supplements the Brother’s Bond Distilling Company, LLC’s Privacy and Cookie Policies and is not
intended to contradict or limit the applicability of the information provided in the Brother’s Bond Distilling
Company, LLC’s Privacy and Cookie Policies.

Section 1: Types of Information Collected


We may collect or process the following categories of personal information as specified in the CCPA:

  • Commercial Information: Commercial information, including products or services purchased and other purchasing or consuming histories or tendencies.
  • Identifiers: Identifiers such as a name, postal address, unique personal identifier, online identifier, IP address, email address, account name, and other similar identifiers.
  • Online Activity: Internet and other electronic network activity information.
  • Sensory Information: Audio, electronic, visual, and similar information.
  • Employment Information: Professional or employment-related information.
  • Personal Information Categories listed in Cal. Civ. Code § 1798.80(e)
  • Protected Classifications: Certain characteristics of protected classifications under California or U.S. federal law, such as age, sex, gender, disability, and military and veteran status.
  • Inferences: Inferences drawn from any of the information identified above to create a profile about you reflecting your behavior, preferences, characteristics, etc.


Section 2: Purpose of Use

We may use the categories of personal information listed above for the purposes described in our Privacy and Cookie Policies and for certain business purposes specified under the CCPA, including but not limited to:

  • To create, maintain, customize, and secure your account with us.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • To fulfill or meet the reason you provided the information.
  • To provide, support, personalize, and develop our website, products, and services.
  • To process your requests, purchases, transactions, and payments and prevent transactional fraud.
  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
  • To personalize your website experience.
  • For testing, research, analysis, and product development, including to develop and improve our website, products, and services.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA.

Personal information does not include:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information excluded from the CCPA’s scope, such as:
    o Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data;
    o Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

Section 3: Our Prior Collection, Use and Disclosure of Personal Information

We may have collected and used your personal information, as described above, during the 12-month period prior to the effective date of this CCPR Statement. For the personal information collected during that timeframe, we describe below: the categories of sources from which we may have obtained the personal information, the categories of third parties with whom we may have shared the information, and
the categories of personal information we may have sold.

We may have obtained personal information about you from various sources, including:

  • Parties we believe to be working on your behalf, such as your legal agent

Sale of Personal Information

We do not sell your personal information in exchange for monetary compensation. We may allow certain third parties (such as certain advertising partners) to collect your personal information via automated technologies on our websites in an effort to serve you content and advertisements that may be of interest to you. This kind of sharing may be considered a “sale” or “sharing” under California law when the personal information is exchanged for non-monetary consideration. The categories of personal information that may have been disclosed in this manner during the 12-month period prior to the date of this CCPR Statement include: identifiers, protected classifications, commercial information, online activity, and inferences. We share these categories of personal information for online advertising purposes as described in our Privacy and Cookie Policies. You have the right to opt out of these disclosures of your information, as detailed below. We do not have actual knowledge that we sell or share personal information of minors under 16 years of age.

You have certain choices regarding your personal information, as described below.

    Verifying Requests. To help protect your privacy and maintain security, if you request access to or deletion of your personal information, we will take steps and may require you to provide certain information to verify your identity before granting you access to your personal information or complying with your request. In addition, if you ask us to provide you with specific pieces of personal information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.

    Shine the Light Requests:
    California Civil Code Section 1798.83 permits you to opt out of the disclosure of your personal information by Brother’s Bond Distilling Company, LLC to third parties for the third parties’ direct marketing purposes.
